These General Terms and Conditions of Sale govern the purchase of products marketed online by ACQUA DI GAETA, with registered office in Via Tranzano Snc, 04023 Formia (LT), VAT IT03142040595, through this e-commerce site.

By placing an order on the website, the Customer declares to have read, understood and fully accepted these General Terms and Conditions of Sale.

  1. SUBJECT

These Conditions govern the online sale of products available on the site, including fragrances, perfumes, home fragrances, sensory items, cosmetics and related products under the ACQUA DI GAETA brand.

ACQUA DI GAETA reserves the right to modify these Conditions at any time. The modifications will be valid from the date of publication on the website and will apply exclusively to orders placed subsequently.

  1. PRODUCTS

The images and descriptions of the products on the website are for informational and representative purposes. ACQUA DI GAETA undertakes to describe each product as accurately as possible.

Any differences between the published images and the actual product may depend on photographic rendering, screen settings or packaging updates.

In the case of artisanal, customized or small-batch products, slight aesthetic, chromatic or packaging variations may occur, without this constituting a defect in the product.

  1. PRICES

All prices indicated on the website are expressed in euros and, unless otherwise specified, include VAT.

Shipping costs, where applicable, are indicated separately before order confirmation.

ACQUA DI GAETA reserves the right to modify prices at any time. The price applied will be the one visible at the time of order confirmation.

In the event of an obvious error in the published price, ACQUA DI GAETA reserves the right to cancel the order, notifying the Customer and refunding any amounts already paid.

  1. ORDERS

The Customer can place an order by selecting the desired products, adding them to the cart and completing the purchase procedure provided by the website.

Before confirming the order, the Customer is required to carefully check the entered data, including shipping address, billing address, selected products, quantity, total price and payment method.

The order is considered received when the Customer receives the confirmation email at the address indicated during the purchase.

ACQUA DI GAETA reserves the right not to accept or cancel orders in case of incomplete or incorrect data, unavailability of products, lack of payment authorization, suspected fraudulent use of payment instruments or technical error.

  1. PRODUCT AVAILABILITY

Product availability is indicated on the website within the limits of actual stock.

In case of total or partial unavailability after the order has been sent, ACQUA DI GAETA will inform the Customer and may propose one of the following solutions:

  • wait for the product to be restocked;

  • replace the product with another available item;

  • cancel the order totally or partially;

  • receive a refund of any amount already paid.

  1. PAYMENTS

Payment for products can be made using the methods available on the website at the time of purchase, including credit card, debit card, PayPal, Shop Pay, Apple Pay, Google Pay, bank transfer or other electronic payment systems that may be active.

The order will be processed only after payment confirmation, unless otherwise indicated.

Payment data is managed through secure third-party platforms. ACQUA DI GAETA does not store the Customer's complete payment card data.

  1. SHIPPING AND DELIVERY

ACQUA DI GAETA delivers products to the address indicated by the Customer during the purchase process.

The delivery times indicated on the website are to be considered estimated and may vary based on product availability, destination, courier used or causes not attributable to ACQUA DI GAETA.

Shipping costs are indicated before order confirmation.

Upon delivery, the Customer is required to check that the package is intact, undamaged, not wet and not altered. In case of visible anomalies, the Customer must accept the package with specific reservation or refuse delivery, promptly notifying ACQUA DI GAETA.

  1. FAILURE TO DELIVER

In case of failed delivery due to absence of the recipient, incorrect address, incomplete data or failure to collect at the point indicated by the courier, any storage costs, redelivery or return of goods may be charged to the Customer.

The Customer is responsible for the accuracy and completeness of the shipping data entered during the order process.

  1. RIGHT OF WITHDRAWAL

The Consumer Customer has the right to withdraw from the contract, without giving any reason, within 14 days from the day on which they receive the product.

To exercise the right of withdrawal, the Customer must send an explicit communication to ACQUA DI GAETA via email to:

The communication must contain:

  • Customer's name and surname;

  • order number;

  • product or products for which withdrawal is intended;

  • order receipt date;

  • email address used for the purchase.

  1. PRODUCT RETURNS

The Customer is required to return the products within 14 days of the withdrawal communication.

Products must be returned intact, unused, undamaged, in their original packaging and complete with any accessories, gifts, samples or included materials.

Direct return costs are borne by the Customer, unless otherwise indicated by ACQUA DI GAETA.

ACQUA DI GAETA reserves the right to reduce the refund if the returned product shows a decrease in value caused by handling other than that necessary to ascertain its nature, characteristics and functioning.

  1. REFUND

In case of correctly exercised withdrawal, ACQUA DI GAETA will refund the Customer the amount paid for the returned products, including any standard delivery costs incurred at the time of purchase, excluding any additional costs resulting from the choice of a delivery method other than the ordinary one.

The refund will be made within 14 days of receiving the withdrawal communication, without prejudice to the right to withhold the refund until the returned products are received or until proof of shipment by the Customer is provided.

The refund will be made using the same payment method used for the purchase, unless otherwise agreed with the Customer.

    EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL

    The right of withdrawal is excluded in cases provided for by applicable law, including:

    • products made to measure or clearly personalized;

    • sealed products that are not suitable for return for hygienic or health protection reasons, if opened after delivery;

    • perishable products or products subject to rapid alteration;

    • products used, damaged, altered or without the original intact packaging, when this compromises their safety or resalability.

    For cosmetic products, fragrances, perfumes or sealed items, withdrawal may not be accepted if the product has been opened, used, tampered with or deprived of the original seal, when this is necessary for hygienic or health protection reasons.

    1. LEGAL GUARANTEE OF CONFORMITY

    All products sold to Consumers are covered by the legal guarantee of conformity provided for by current legislation.

    In case of a defective or non-compliant product, the Customer must contact ACQUA DI GAETA by writing to:

    The communication must contain:

    • order number;

    • description of the defect found;

    • photographs of the product and packaging, if useful;

    • Customer data.

    In case of an ascertained defect, ACQUA DI GAETA will proceed, in accordance with applicable legislation, with replacement, repair, price reduction or refund.

    The warranty does not cover defects or damage caused by improper use, incorrect storage, negligence, tampering, normal wear and tear, exposure to heat sources, direct light, humidity or conditions unsuitable for the nature of the product.

    1. PRODUCTS DAMAGED DURING TRANSPORT

    If the Customer receives a visibly damaged, opened, wet or altered package, they must immediately report it to the courier and, if possible, accept delivery with specific reservation.

    The Customer must inform ACQUA DI GAETA shortly after delivery, attaching photographs of the package, shipping label, packaging and damaged product.

    ACQUA DI GAETA will evaluate the report and provide instructions for possible replacement, refund or opening of the claim with the courier.

    1. CORRECT USE OF PRODUCTS

    The Customer is required to use the products according to the instructions on the packaging, label or product sheet.

    Products must be stored in a cool, dry place, away from heat sources, direct light, open flames and out of the reach of children, unless otherwise indicated.

    ACQUA DI GAETA is not responsible for damages resulting from improper use, use other than that intended, undeclared allergies, failure to follow instructions or incorrect product storage.

    1. INVOICING

    Customers who wish to receive an invoice must request it during the order process, correctly entering all necessary data, including company name, full address, tax code, VAT number, recipient code or certified email address (PEC).

    Once the tax document has been issued, any modifications can only be made if permitted by current legislation.

    1. LIABILITY

    ACQUA DI GAETA will not be liable for delays, inefficiencies, non-delivery or inability to execute the order resulting from force majeure, unforeseeable events, strikes, natural disasters, transport blockades, technical malfunctions, interruptions of payment services or causes not directly attributable to ACQUA DI GAETA.

    ACQUA DI GAETA's liability remains firm in cases mandatorily provided for by law.

    1. PRIVACY

    The Customer's personal data is processed in compliance with current legislation on personal data protection, including EU Regulation 2016/679.

    For more information on the processing of personal data, the Customer is invited to consult the Privacy Policy published on the website.

    ACQUA DI GAETA undertakes to respond to complaints within a reasonable time from receiving the communication.

    1. APPLICABLE LAW AND COMPETENT COURT

    These General Terms and Conditions of Sale are governed by Italian law.

    For Consumer Customers, the competent court is that of the Consumer's place of residence or domicile, if located in Italian territory.

    For Professional Customers or companies, the competent court will be that of Latina, unless otherwise mandatory court provided for by law.

    1. FINAL CLAUSE

    The possible nullity, ineffectiveness or invalidity of one or more provisions of these Conditions does not entail the nullity, ineffectiveness or invalidity of the remaining clauses, which will continue to remain valid and effective.
